A federal trademark gives you exclusive nationwide ownership of your business name, logo, or design.

Three Essential Trademark Agreements
With Nolo's Tradmark Application, you will also receive three important contracts that will help you live with and protect your trademark: Those contracts are:
- Trademark Assignment. This agreement should be used when you are transferring all rights to your trademark to another person or company. For example, use it if your company merges with another entity, if you sell all of your interest in your company, or if you change the entity that owns the trademark, say transferring all rights from a partnership to a corporation. An assignment is almost always a permanent transfer of rights.
- Artwork Assignment. If you hire someone to create a trademark (and particularly if that trademark includes artistic elements) you should have the artist assign (or sell) all rights to your company. This agreement will guarantee your ownership of that artwork. An assignment is not required if the trademark is created by an employee with the course of employment.
- Trademark Permission for Movie or Photo. Acquiring trademark permissions differs within various industries. Often, permission is not legally required and a court will permit an unauthorized use. However, since book publishers, software companies, advertisers, internet providers, and movie companies do not want to risk a lawsuit, they seek permission anyway. This form will enable you to use a trademark in a motion picture or within a photograph.

The USPTO charges a required filing fee of $325. This amount is not included in our package prices. This fee will be added to your total when you check out. The USPTO's filing is not refundable after the application is filed.
Neither the filing fee nor the package fee is refundable if the USPTO rejects your trademark.
